RIM is offering business customers a completely free BlackBerry PlayBook... when they buy two.<br />
The 'Back to Business' promotion, which RIM says is aimed at kitting-out small businesses with PlayBooks will run from now until December 31st 2011.<br />
The somewhat desperate attempt to shift some of RIM's over-flowing PlayBook inventory will include three free accessories per tablet.<br />
Buyers will get a 6ft HDMI cable, a black leather sleeve and a charging pot absolutely gratis.<br />

Software update delayed</h4>
The 'special offer' comes after RIM revealed, this week, that it would be delaying a much needed PlayBook software update until February 2012.<br />
The PlayBook is yet to gain a native email application, while the long-promised Android app player remains a pipedream.<br />

All-in-all, it has been another week to forget for the Canadian giant.<br />
The software delays caused stocks to crash once again, while on Wednesday night it was hit with a class action lawsuit over the internet services outage which left millions without BBM and email earlier this month.<br />

Apple filed a lawsuit against Samsung in the Netherlands claiming the Galaxy S too closely resembles the iPhone. Unfortunately, the evidence submitted in the case appears to misrepresent the Galaxy S handset. In an image provided by Apple in the filing, the Samsung Galaxy S smartphone is the same size and shape as the iPhone 3G. The shipping version of the Galaxy S, though, is taller and slightly thinner than the iPhone.</div>

This is the second faux pas that Apple has made in a legal filing. Earlier this week, it was discovered that the images of the Galaxy Tab Apple provided to a German court did not accurately represent the device. In light of this revelation, the German court temporarily relaxed the ban on the sale of the Galaxy Tab 10.1 in the EU. As of the writing of the post, neither the Netherlands court, Apple nor Samsung has commented on this discrepancy.</div>

Samsung later responded and now we are seeing reports that Apple might have altered some of the evidence. This covered all of the European Union except for the Netherlands, so now Apple is headed for that region too.</div>

We all knew it was coming but now its been confirmed that Apple will be seeking the same injunction against Samsung products in the Netherlands. They are going after all tablets and smartphones here, rather than just the Galaxy Tab 10.1 like we’ve seen thus far. Apple’s new, parallel filing in the Netherlands details patent infringement also, rather than just copying design elements like in the European case. Reports are suggesting Apple’s request is for an injunction against ALL of Samsung’s Android offerings this time around rather than just phones or tablets.</div>

Similar lawsuits were also filed in Australia but were denied and even the same German court that applied the injunction for the EU has now revised his ruling making the ban only in Germany for now. While this is all still heating up and just getting started I wish it would all just go away already. I have a feeling this will get drawn out for a while but hopefully Google’s acquisition of Motorola will start helping out if that deal indeed goes through.</div>

This update is a response to a tweet from a Microsoft employee, calling out Google, saying that Microsoft invited Google to join their collective bid for patents recently. Lets get straight to it. According to their official blog, Google would have been buying those patents as leverage to deter companies such as Microsoft and Apple from going after Android, and Google’s partners in the Open Handset Alliance. Since buying the patents collectively would have granted all the companies involved a license for the patents in question.</div>

Basically, Google only wanted these patents if the others involved DIDN’T. That would allow them to threaten to sue the others if they sued Android device manufacturers. In other words, Google was looking to create a sort of “patent Cold War.” Hardly the high road, but it IS pretty standard practice these days.</div>

Google claims that Microsoft’s invitation was merely a trick which would have let Google help foot the bill, while neutering the patents as a defense for Android. Its good to see Google speaking out in defense of its partners with Android, but whether it will do any good is yet to be seen.</div>

Samsung originally planned to host a media event on August 11 for the Australian launch of its Galaxy Tab 10.1, but it has now officially been postponed, according to TechCrunch. Over the past couple of days, Samsung's story has changed multiple times. First it said the Galaxy Tab would launch in Australia despite Apple's patent-related complaints to Australia's Federal Court. Then, Samsung said it had no plans to launch the Galaxy Tab in Australia in the first place, and its decision had nothing to do with Apple's complaint.</div>

The latest update on the matter seems to be a combination of all the previous takes. The company also states that the decision to postpone the Australian launch is directly tied to the current legal situation with Apple. Samsung appears to be trying to work around the patent battle by producing a specialized Australian variant of the Galaxy Tab, but the unit is still in production with no ETA for a launch, and TechCrunch speculates that launching a variant of the same product may violate the spirit of the agreement.</div>

<P align=center><img src="http://img42.imageshack.us/img42/6460/honeycombmedia200200.jpg"></P><br /><P>Microsoft co-founder Paul Allen has re-filed a more detailed version of a lawsuit originally filed earlier in 2010, claiming that several high-profile tech firms are guilty of patent infringement – including Google, Facebook and Apple.</P><br /><P>Allen's Interval Licensing, the patent arm of Interval Research, filed the revised patent infringement lawsuit against these big-hitting tech giants this week.</P><br /><P>The US district court told Allen's lawyers that Interval had until December 28 to refile the lawsuit, which is exactly what they have done.</P><br /><P><STRONG>Patently hopping mad</STRONG></P><br /><P>The new lawsuit includes numerous screengrabs of websites and services that Interval claim shows infringement on its patents.</P><br /><P>The lawsuit accuses Apple, Facebook, eBay, Netflix, AOL, Yahoo!, Office Depot, OfficeMax, YouTube and Staples of infringing on four patents held by Interval Licensing that relate to e-commerce and online search functions. </P><br /><P>FOSS Patents' <a href="http://fosspatents.blogspot.com/2010/12/paul-allens-interval-licensing-refiles.html">analysis of the patent complaint</A> by notes that Google's Android operating system – and its notification system for texts, Google Voice messages, emails and other alerts "to a user of a mobile device in an unobtrusive manner that occupies the peripheral attention of the user" – is directly under fire from Allen's lawsuit.</P><br /><P>"If any of those infringement assertions against Android [are] true, this can spell trouble for makers of Android-based devices, and for Android application developers," notes FOSS Patent's Florian Mueller. </P><br /><P>"Patent holders can choose to sue Google, device makers, application developers, users, or any combination of the foregoing options." </P><br /><P>Expect to hear a lot more on developments in Paul Allen's patent infringement lawsuit against Facebook, Apple, Google, and others as this particular tech patent drama plays itself out in court in the coming weeks.</P>

Alcatel-Lucent trust sues Apple and others over video patents

The lawsuit was filed on Monday in the U.S. District Court for Southern California by the Multimedia Patent Trust. The MPT is a subsidiary of <a href="http://www.alcatel-lucent.com/">Alcatel-Lucent</a> that was formed when Alcatel merged with Lucent Technologies in 2006. The MPT controls and defends a block of patents previously owned by Lucent. The company has a litigious history and has filed infringement lawsuits against Microsoft, Dell, Disney and DirecTV. <br />

The four patents listed in this infringement case focus on video codecs with Apple allegedly infringing on three of the four patents. Cited in the complaint are Apple's <a href="http://www.apple.com/macbook/">MacBook lineup</a> of laptops, the iPhone and its video editing solution, <a href="http://www.apple.com/finalcutstudio/finalcutpro/">Final Cut Pro</a>. Apple is not alone in this lawsuit; Canon cameras and camcorders, LG mobile phones and TiVo DVR equipment are also being targeted by MPT. MPT is asking for past royalty payments from these alleged infringing products and, at least for Apple, is not seeking an injunction.<br />
