Report: Apple 'likely to lose' App Store trademark case

Apple is likely to lose its court battle to prevent Amazon using the term Appstore for its mobile app offering, according to the judge presiding over the case. Bloomberg reports that US District Judge Phillys Hamilton admitted that she is "probably" going to deny Apple's request following a hearing in Oakland, California on Tuesday. Judge Hamilton says that Apple has been unable to demonstrate that Amazon's naming has created confusion among consumers. No evidence of confusion During the hearing, she said that Apple had so-far failed to offer "real evidence of actual confusion" among customers which is a "stumbling block" for the company "I'm troubled by the showing that you've made so far, but that's where you're likely not to prevail at this early juncture," she added. Amazon raised the ire of Apple back in March when it decided use the term Appstore for its Android app shop, claiming that its own App Store holds that trademark. Windows win? Amazon wants the trademark infringement case to be dismissed, clearing the way for them, and perhaps others, to use the term. The court proceedings may have implications for Microsoft's ongoing battle to open up the name "Appstore" for its own Windows Phone platform.

HTC Scribe turns up in US trademark filings, could be a tablet

It's an open secret at this point that HTC is almost certainly working on one or more tablets for introduction in 2011 -- and with heavyweights like Samsung, Motorola, and LG all playing the game (or about to play the game), really, how could they not? PocketNow has unearthed a very fresh trademark filing with the US PTO -- filed this past Sunday -- for "HTC Scribe," described as a "handheld wireless device, namely, a tablet computer." Doesn't get much more definitive than that. Of course, companies file for marks that they don't ultimately end up using all the time -- from their perspective, it's better to shoot first and ask questions later -- so it's not a slam dunk, but when you think about it, Scribe could actually be an awesome name for a little Honeycomb tablet. Only question is, are we going to see this stuff next week at CES or in February at MWC?

Facebook given greenlight to trademark its 'Face'

Facebook has made some serious steps in protecting its brand by showing its intent to trademark the word Face. 
A Notice of Allowance has been granted to the social-networking site, which is the first step in taking ownership of the use of Face in certain circumstances. 
The <a href="http://tarr.uspto.gov/servlet/tarr?regser=serial&entry=78980756">Notice of Allowance</a> states that, if successful, Facebook would be the only ones who can use the word Face for the following: "Telecommunication services, namely, providing online chat rooms and electronic bulletin boards for transmission of messages among computer users in the field of general interest and concerning social and entertainment subject matter, none primarily featuring or relating to motoring or to cars." 
Facing facts 
Facebook now have three months to pay a fee and then it can start trademark proceedings. 
Considering that Apple currently uses the word Face for its Facetime service – which must fall under the banner of 'telecommunication' – it will be interesting to see if this would be encroaching on the soon-to-be Facebook trademark. 
And let's not get started on what the A-Team will do if the trademark becomes a reality.
