The San Jose Mercury News is reporting that two people involved in last year's "iPhone 4 prototype found in a bar" fiasco are being charged in San Mateo County Superior Court for their respective roles in the incident, which led to numerous photos of the upcoming iPhone model being posted online months ahead of its official release.</div>

Brian Hogan, the individual who is credited with finding the iPhone, is being charged with one count of misappropriation of lost property, a misdemeanor in the state of California. Sage Wallower, Hogan's friend who assisted him by contacting a number of tech blogs and offering to sell the device to them, is also being charged with possession of stolen property.</div>

Neither of the two individuals appeared at the hearing regarding the charges, and the attorneys for both men entered not guilty pleas on their behalf. A second hearing on the case is expected on October 11th, and a trial date has been set for November 28th, although Hogan's attorney has indicated that his client has taken responsibility for his actions, and he plans to work with prosecutors to strike a plea bargain.</div>

It was reported earlier this month that the blog responsible for purchasing the iPhone and releasing the pictures, Gizmodo, will not be charged in the incident. Jason Chen, the blogger who facilitated the exchange and wrote the post, will also not be charged. Chen's house was searched early in the investigation, and several items were seized, but later returned.</div>

For the record, a quick check thanks to Wikipedia and a calculator shows the people have spoken, loudly. According to the electoral colleges of the United States of America, Android is the best OS by a landslide of 245 electoral votes to iOS’s 134 and BlackBerry’s 83. Note these numbers may not be exact, but as an engineering student, I’ve been told I’m decent at math.</div>

Yesterday we told you that this Saturday will see the opening of Apple's second Glendale, California store -- one that is only 600 feet away from the other Glendale store. If that alone isn't enough to give the first store feelings of inferiority, perhaps the features of the new store will push it over the edge.</div>

According to 9to5Mac, the new Glendale store will feature a floating Apple logo suspended in the store's glass front. This is the same treatment New York's Fifth Avenue cube store got. The second Glendale store will also have a massive Genius Bar -- a full fifty seats. In addition, the new store will feature a briefing room for business customers and a few tables dedicated entirely to Startup Sessions. To top it off, at 7000 square feet of retail space, the new Glendale store is Apple's largest store in a mall.</div>

Apple is definitely an out with the old, in with the new company. However, at least they decided not to shutter the existing Glendale store. The group made its latest feat known via Twitter early Thursday morning, claiming to be sitting on 1 GB of sensitive data. Given the sensitivity of its new-found booty, the group actually refuses to publish <span class="Apple-style-span" mce_fixed="1" mce_name="em" mce_style="font-style: italic;" style="color: #444444; font-family: Georgia, 'Bitstream Charter', serif; font-style: italic; line-height: 1.5;">all</span> the data, saying that to do so would be “irresponsible.”</div>

The NATO hack arrives just after the FBI conducted a sweep across the nation on Tuesday, arresting 16 alleged Anonymous members. 14 individuals were arrested in Alabama, Arizona, California, Colorado, the District of Columbia, Florida, Massachusetts, Nevada, New Mexico, and Ohio. Two other individuals were arrested on similar charges in two separate complaints filed in the Middle District of Florida and the District of New Jersey.</div>

“These governments and corporations are our enemy. It is our mission to help these people and there is nothing – absolutely nothing – you can possibly to do make us stop.”</div>

Report: Apple 'likely to lose' App Store trademark case

Apple is likely to lose its court battle to prevent Amazon using the term Appstore for its mobile app offering, according to the judge presiding over the case.<br/><br/>Bloomberg reports that US District Judge Phillys Hamilton admitted that she is "probably" going to deny Apple's request following a hearing in Oakland, California on Tuesday.<br/><br/>Judge Hamilton says that Apple has been unable to demonstrate that Amazon's naming has created confusion among consumers.<br/><br/><strong>No evidence of confusion</strong><br/><br/>During the hearing, she said that Apple had so-far failed to offer "real evidence of actual confusion" among customers which is a "stumbling block" for the company<br/><br/>"I'm troubled by the showing that you've made so far, but that's where you're likely not to prevail at this early juncture," she added.<br/><br/>Amazon raised the ire of Apple back in March when it decided use the term Appstore for its Android app shop, claiming that its own App Store holds that trademark.<br/><br/><strong>Windows win?</strong><br/><br/>Amazon wants the trademark infringement case to be dismissed, clearing the way for them, and perhaps others, to use the term.<br/><br/>The court proceedings may have implications for Microsoft's ongoing battle to open up the name "Appstore" for its own Windows Phone platform.
