What Does Computer Law Cover And Why Is It Necessary?

A decade or so ago there was no such thing as computer law. This niche of the legal system has come into being out of necessity with the proliferation of the Internet and the issues that come along with the technology that makes worldwide communication and transactions possible. Traditional law does not cover many of the issues that occur in the online realm. Therefore it is crucial that we have a particular branch of law that exists to deal with legal problems that may arise by the very nature of the Internet and are not able to be covered by local jurisdictions. There may be disagreements over copyright or ownership of a domain or website which cannot be resolved due to the parties being in different states or even different countries. The problem that arises here is that there are complex problems in deciding what state or country's law and jurisdiction will have the authority to resolve the issue. In situations like this the area of law known as "Conflicts of Law" comes into play. The increasingly complex area of computer law is exceedingly demanding in its educational requirements for attorneys who practice in this niche. The term "computer law" is kind of a misnomer since it is really the information on the computer such as software, personal info, and possible trade secrets that are the issue as well as the possibility of international disputes over domain names and copyright violations. For these reasons, those who practice computer law are usually the same attorneys who specialize in Intellectual Property Law, also known as IP Law, which covers trademarks, patents, copyrights, and trade secrets. The U.S. Patent Office requires attorneys practicing before it to hold a bachelor's degree in the areas of engineering or science at the very least. Some traditional areas of law are evolving to include ever-changing computer laws. Early on it was declared that software would be classified as "goods", but the difference between normal goods and software "goods" is that one only owns the media that the software is stored on and a license to the use of the software which is now covered under the Uniform Commercial Code. Those who hack into computer systems without authorization and use that computer's resources or steal information from it are guilty of pretty much the same thing as what traditional law would call burglary. However, since by definition burglary means entering an actual physical residence, specific laws were added to cover this offense. One of the biggest problems with the Internet and one that grows even larger annually is that of copyright theft and piracy. Anyone with a computer and access to the Internet can easily steal the intellectual property of another. Additionally, the piracy of media such as movies and music is an enormous problem that is plaguing those industries today. It is a fact that the area of computer law will continue to expand and be used more in the future as the use of the Internet to commit crimes continues to grow.

Pen Drive - A Necessary Evil?

Technology has always been a necessary evil. The more the technology develops, the greater are the chances of its being abused. Pen drive, the small storage device used to store and transfer data to and from computers, has gained popularity due to its functionality. It has got thousands of uses. Ease of use and convenience is the prime reason of its popularity. However, like many other equipments, pen drives are also a necessary evil and pose a potential security threat to the technology world. When placed in wrong hands, the portability and high storage capacity of the pen drive can be hazardous. The device has evolved as a threat to the corporate and other organizations where security of data is given utmost importance. The threats that are associated with pen drives are serious. Some of them are listed below.Stealing of data:Apart from the defense department, the corporate sectors all over the world are under the threat of data theft for espionage. There is no dearth of incidents where spies, hackers and other source are employed to steal data. A pen drive gives ample of opportunity for the theft from an unattached or unlocked PC with a USB port. It is easy to access data and steal information like client list, research data or any other information. The hackers can even bring the software with a pen drive allowing the user to hack password or other confidential information.Spreading virus:Earlier, floppy drives and emails were considered as main source of virus to computers. However, there has been anti-virus software developed to counter virus and protect the PC. But with pen drive it is difficult to check the virus with the safeguard as the device can bypass the protection. It is almost impossible to defend against the viruses unless and until you have strong anti-virus policies or you are not scanning all files in your network. It is easy for a virus writer to corrupt the entire network of a corporate environment with a pen drive.Plant malicious software:Virus apart, it is not difficult for anyone to take any spamware and plant it in the PC. In corporate sectors the threat multiplies when employees use pen drives to bring unauthorized software or any other data such as software pranks, sharewares, mp3 files, pornography pictures, video clips and other inappropriate data that is against the corporate ethics. As pen drives allow more space, it is easy to bring bulky software which impossible with a floppy. Situation worsens when the software is used to crack password.Causing data loss:Pen drives barely allow any security system in terms of password or any other built in security feature. So it is more likely that if a person loses a pen drive, the data inside it can be accessed by anyone. If it falls in wrong hands he or she can misuse it. a pen drive can be easily stolen or misplaced and the data stored inside it can be easily manipulated. There have large demand for pen drives with some security systems such as finger-print reader or protective software. There has been a conscious protest against pen drives in many private and government organization. Though it is a convenient device for the productive brains, it has proved to be beneficial for the thieves as well. Pen drives are small in size and have greater capacity to store information. Hence the thieves can carry the device stealthily in pockets and take information.Unless and until any drastic step has been takes against it, the security of any organization can be in stake. Even a visitor can retrieve data easily from an open computer. Considering these threats, some companies have taken some protective measures for their security by banning pen drive inside company premises. It can reduce the threat to some extent. Roberto Sedycias works as IT consultant for <a href="http://polomercantil.livejournal.com/" target="_new">Polomercantil</a>

Credibility In Business A Necessary Risk

If your desire is to create a business on-line, you will find that it is getting more and more difficult to do so. Why? Credibility. You really should consider what you are doing as relationship business. With the increase in scammers and hoax products, with good reason, the public is becoming increasingly pessimistic about doing business with strangers on-line. What a shame. In my opinion, the telephone will never be obsolete. At some point, I have found that you need to pick up the phone and connect with potential business partners. After all, doing business - on or off line, home based or otherwise and certainly marketing - continues to remain a relationship business. People are getting into business with people. That continues to make this an exciting business model; and the ability to build a strong business requires developing relationships. How better to do this than with personal communication. If you are not willing to share personal contact information, then you will have difficulty getting your business off the ground. On the other hand, you also are at risk by putting your personal information 'out there'. This is the age of photo-shopping and cutting and pasting. So with the advancement of technology comes the loopholes through which the scammers creep through. Unless you are a techy, most of this will be learned, unfortunately, through trial and error.I suppose this would be the best place to state the obvious. In being proactive, secure your computer from malicious internet attacks of all types by using antivirus programs and firewalls. Because you are no doubt wanting and needing responders to your site(s), you are opening yourself up to viruses hidden in emails. You need to make sure that all email is checked for viruses before you open it. Depending on what type of email program you use, your virus checking software or the email provider will check unopened email for viruses. I would caution that I was hacked while using one of the web-based free programs. Your firewall is your main defense against hackers. Therefore, it is worth the investment to purchase a good program. To put this all in perspective, however, we need to consider how else and when else in history have we been able to reach across the nation and the world to build businesses with such ease from the comfort of our homes? If we are to be successful in home-based business, the Internet is the key tool in our arsenal. But I also know that if I want to be successful in marketing on the Internet, I must continue to develop safeguards for myself and, yet, move forward. Case in point: The sabotaging of my blog, which forced me to move to another provider and also has caused some issues for me relative to formatting, etc.I will continue to work through issues and educate myself on the ins and outs of Internet based home business, regardless. And I refuse to let the small number of those in cyberspace who seek to do harm to others dissuade me. Why? Because this is the future of doing business. [Actually, the future is here.] And also because of credibility. Beside, I know that it is important for you to know who the heck I am. <a href="http://bloggingformoneysite.com" target="_new">http://bloggingformoneysite.com</a>
